An
Akure Chief Magistrates’ Court, yesterday, ordered that a 17-year-old
SSS 2 student be remanded in police custody over alleged stealing said
to have been committed with her boyfriend.
The
boyfriend, Samuel Fadeyi, 21, a driver, was, however, granted bail by
the Chief Magistrate, Mrs Adejoke Adegoroye, in the sum of N50,000 and
one surety in like sum.
The two accused persons were arraigned on a two-count charge of conspiracy and stealing brought against them by the police.
The
police prosecutor, Sgt Martins Olowofeso, told the court that the two
committed the offence on March 13, about 10.20p.m. at 21, Iro Street,
Akure, in Akure Magisterial District.
He
said that they stole one Nokia X2 mobile phone valued at N20,000 and
another Nokia phone valued at N2,000, both belonging to one Segun
Samuel.
The
offence, the prosecutor said, was contrary to and punishable under
section 390 (9) of the Criminal Code Cap 37 Vol. I laws of Ondo State
2006.
The plea of the accused persons was not taken, but they told the court that they understood the charges.
The
prosecutor informed the court that he had three people to testify
against the accused persons and prayed the court to grant an adjournment
to enable him to assemble his witnesses.
Counsel
to the accused persons, Mr Abiodun Umoru, did not object, but urged the
court to admit his clients to bail on liberal terms.
Ruling
on the bail application, the magistrate said that since the parents of
the female accused were not in court, she should be remanded in police
custody because she is a minor.
She
said that her bail application would be considered on March 21, and
told the police to make sure that her parents were in court on that day.
While
granting bail to Samuel, she ruled that the surety must present an
affidavit of means and be resident within the jurisdiction of the court.
She adjourned the case till March 21, for hearing and consideration of bail for the second accused.
